The Scopes foot race of 1925 marks one of the ACLUs earliest battles. In Dayton, TN, legislatures state teaching any doctrine regarding evolution was unlawful as it denied the divine creation of creation of man as taught by the Bible.

In retaliation, the ACLU enlisted high school teacher John T Scopes to test system and violate state law by teaching Charles Darwins theory of evolution. Scopes was eventually prosecuted and the ACLU with attorney Clarence Darrow, forbidden together to defend him. The state of Tennessee, however, found Scopes guilty plainly the verdict was later overturned. The guilty verdict did little at the moment to change the Tennessee law, but it did demonstrate the importance of schoolman freedom in America.
